for access to the SozdavAI service

This document is a public offer of Iskender Abdullayev and sets the terms for services provided through SozdavAI at sozdavai.com.

It is an invitation to conclude a contract. Actions listed below that show acceptance are an acceptance of the offer under the law of the Russian Federation.

1. Terms

1.1. Provider — Iskender Abdullayev, Regensburgerstrasse 342c, 90480 Nürnberg, Germany.

1.2. User — a natural person, individual entrepreneur or legal entity that uses the Service and/or concludes a contract by accepting this Offer.

1.3. Service / SozdavAI — the software service at sozdavai.com that provides AI tools, including generation and processing of images, video, text and other digital content.

1.4. Generation — an automated operation that processes the User’s Request with one or more AI models.

1.5. Request / Prompt — text, images, video, files, parameters and other data sent by the User for Generation.

1.6. Result — the digital output produced from the User’s Request.

1.7. Credits — an internal unit that accounts for prepaid Service usage. Credits are not money, e-money, digital currency, a security, a standalone good or a means of payment, and are not intended for settlements between Users.

1.8. Plan — terms for a given number of Credits and/or Service features at a set price.

1.9. AI provider — a third-party supplier of software, compute, APIs or AI models used for Generation.

2. Subject

2.1. The Provider gives the User access to SozdavAI and, on request, automated generation and processing of digital content. The User pays under the chosen Plan.

2.2–2.4. SozdavAI may use the Provider’s own technology and third-party AI providers. Models, functions, Generation prices, Credit costs, limits and Plans are shown in the interface. The Provider may change available models, providers and features if this does not take away a volume of service already paid for.

3. Acceptance

The User must read this Offer before paying. Full and unconditional acceptance is any action that clearly shows consent, including confirmation in the interface and payment. From that moment a paid services contract is formed. If the User disagrees, they must not pay or use paid features.

4. Registration

Some features require an account. The User must provide accurate data, keep access details safe, and is responsible for actions taken through the account unless they promptly report unauthorised access.

5. Credits and payment

Paid services are prepaid in Credits. The Credit price of a Generation is shown before launch. Unused Credits from a paid Plan are used under the Offer and the refund policy. Credits are not withdrawn in cash except as required by law or the refund policy.

6. Generation and Results

Generation is automated. Results may differ from expectations. The User is responsible for the lawfulness of Requests and for how Results are used. The Provider does not guarantee a specific creative or commercial outcome.

7. Intellectual property

The Service, software and brand belong to the Provider. Rights in User materials stay with the User. The User grants the Provider a licence to process Requests as needed to provide the Service. Rights in Results are determined by the Offer, the interface and the terms of the AI models used. Commercial use may depend on a specific model’s terms.

8–10. Restrictions, quality, liability

The User must not break the law, generate prohibited content, attack the Service or resell access without consent. The Service is provided “as is”. The Provider is not liable for AI provider failures, User content or third-party claims arising from the User’s Requests or publications, except as required by law. Liability is limited to the amount paid for the unused volume of the relevant service, unless mandatory law says otherwise.

11–14. Personal data, changes, term, disputes

Personal data are processed under the privacy policy. The Provider may update the Offer by publishing a new edition. The contract lasts while the User uses the Service and/or has unused paid volume. Disputes are resolved under Russian law, with a claim to be sent to the Provider first.
